Jaksam Terms of Service

1. Purpose
These Terms of Service (“Terms”) govern the conditions and procedures for using the music lesson recording and practice management service (“Service”) provided by Jaksam (“the App”), and define the rights, obligations, and responsibilities between users and the App operator.
2. Definitions
- “Service”: All features provided through the App, including lesson recording, practice management, AI analysis and coaching, and teacher/parent linking.
- “User”: Any person who agrees to these Terms and creates an account to use the Service.
- “Student”: The primary user role that records lessons and tracks practice.
- “Teacher”: A role linked to students via invite code, with access to view student data and modify practice plans.
- “Parent”: A role linked to students via invite code, with read-only access to student data.
- “AI Coach”: The AI-powered feature within the App (Jaksam) that provides personalized practice feedback and coaching.
- “Content”: All materials created, uploaded, or stored by users through the Service, including recordings, text, and images.
3. Acceptance and Changes to Terms
- These Terms take effect when you create an account and agree to them.
- The operator may modify these Terms within the bounds of applicable laws.
- If the Terms are modified, we will notify you of the changes and the effective date at least 7 days in advance via in-app notice or email.
- If you do not agree to the modified Terms, you may discontinue use of the Service and delete your account.
4. Account Registration
- To use the Service, you must create an account by providing a valid email address, password, display name, and role (student/teacher/parent).
- Social login via Kakao or Apple is also supported.
- You must provide accurate and up-to-date information and are responsible for maintaining the security of your account.
- Each person may create only one account. Accounts may not be shared with or transferred to others.
- Users under 14 years of age may use the Service with parental or guardian consent.
5. Description of Service
The App provides the following services:
- Lesson Recording: Record music lessons as audio or video and store them securely.
- AI Analysis: Automatically transcribe recorded lessons and generate summaries and practice plans.
- Practice Management: Record practice sessions and track practice time and frequency.
- AI Coaching: The AI Coach (Jaksam) provides personalized practice feedback, daily practice recommendations, and weekly check-ins.
- Teacher/Parent Linking: Connect with teachers and parents via student-generated invite codes to share learning data.
- Push Notifications: Receive alerts for lesson processing completion, practice reminders, and AI coaching messages.
6. AI Features and Data Processing Consent
- The App’s core features are powered by AI technology (OpenAI API).
- Explicit consent to AI data processing is required when you first use the Service. The Service cannot be used without this consent.
- For details on the scope of data processed by AI and third-party sharing, please refer to our Privacy Policy.
- AI-generated content (summaries, practice plans, coaching messages, etc.) is for reference only and does not replace professional music instruction.
- We do not guarantee the accuracy or completeness of AI-generated content.
7. User Content
- You retain ownership of all Content you create or upload through the Service (recordings, text, images, etc.).
- You grant the operator a non-exclusive, royalty-free license to use your Content to the extent necessary to provide the Service (storage, AI processing, sharing with linked teachers/parents, etc.).
- When you delete your account, all Content is permanently deleted after a 30-day grace period.
8. User Responsibilities
Users must not:
- Misappropriate others’ personal information or provide false information.
- Record others’ voices, performances, or conversations without their consent.
- Circumvent or disable the App’s technical protection measures.
- Use the Service in abnormal ways that overload the system.
- Distribute illegal content through the App.
- Engage in any other activity that violates applicable laws.
9. Teacher and Parent Data Access
- Teachers and parents can only access student data through invite codes generated by the student.
- Teachers have permission to view linked students’ lesson data and modify practice plans.
- Parents can view linked students’ data in read-only mode.
- Students may unlink from a teacher or parent at any time, which immediately revokes that teacher’s or parent’s access.
10. Service Interruption and Changes
- The operator may temporarily suspend the Service for system maintenance, equipment replacement, or technical issues.
- The operator may modify the Service’s content and operation, with advance notice for significant changes.
- For free services, the operator may discontinue the Service due to operational circumstances, with prior notice.
11. Account Termination and Restrictions
- You may request account deletion at any time through the App’s settings.
- A 30-day grace period applies after an account deletion request. Logging in during the grace period cancels the deletion.
- After the grace period, all personal information and Content are permanently deleted.
- The operator may restrict service use or suspend accounts for violations of these Terms, with prior notice. In urgent cases, notice may be given afterwards.
12. Disclaimers
- Service Provision: The Service is provided “as-is.” We do not guarantee fitness for a particular purpose, uninterrupted availability, or error-free operation.
- AI-Generated Content: Summaries, practice plans, and coaching messages generated by AI are reference materials and do not replace instruction from a professional music teacher. The operator is not responsible for decisions made based on AI-generated content.
- Recording Content: Users are responsible for obtaining any consent required by applicable law for their recordings.
- Data Loss: The operator is not liable for data loss caused by force majeure events such as natural disasters or system failures, though reasonable security measures are maintained.
- Third-Party Services: The operator’s liability is limited for service impacts caused by outages or policy changes of third-party services (OpenAI, Supabase, etc.) used by the App.
13. Liability
- If the operator’s intentional or grossly negligent actions cause damage to a user, compensation will be provided in accordance with applicable laws.
- For free services, the operator bears no liability for damages absent intentional or grossly negligent conduct.
14. Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
- Disputes related to the Service shall be resolved through consultation between the parties. If consultation fails, either party may file a claim with the competent courts of the Republic of Korea.

These Terms of Service comply with the Republic of Korea’s Act on Consumer Protection in Electronic Commerce, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and other applicable laws.
